The patent would not be Edge's it would be the inventors Brad Odom. A patent has been applied for and would of course not just cover the shape of the cuts, but the utility in having a bucket that has any shape pockets for the purpose of holding spray bottles and keeping them from freely moving about the outer rim of the bucket. A patent should in theory give the owner the right to stop anyone from making, using, buying, or selling such a product but going to eveyones home or garage to police it is obvioulsy not feasible. The adavantage to this would simply be that they are manufactured for balance and perfect cuts and would cost about the same as a bucket without them. We thought Brad had a great idea and I give him alot of credit for following through on it to make it a real product. We thought we could help him manufacture it cost effectively and help market it but the idea, product, and rights are HIS. As someone who has been through the patent process and idea to product realization many times, I think Brad did a great job and should be commended.

Shady said that his/their "design" is patent pending. I would assume another design would be ok. Isn't there a difference b/t patented and patent pending? Trying to dig into my business law cobwebs and man are they thick right now. I think its a good idea, I bet almost everyone has though about this at one point he is just following through on a larger scale. Sure it can be done yourself too.
So Edge am I right to say that for instance someone could make these buckets and sell them during (Brads) patent pending period and once the patent is final (Brad) can pursue royalties from the other person.
Sorry we are highjacking a thread but this can be educational too.

zymol offers a similer item a nylon holder that goes around a 5 gallon bucket to hold your spray bottles brushes ect. you cant get a patent on items that are similer. people out there are always looking for a get rich item to invent its just not that easy and a patent cost a like 100 grand if not more.

A holder is very different than a bucket that incorporates the holders. Any patent lawyer will tell you the difference. You can actually get a patent on ANYTHING so long as it is very specific. The key is to make it cover as much as possible to have any worth out of a patent. Patents of this variety do not cost anywhere near 100 grand, maybe 5-7 at the most. This is far from a get rich scheme, more like a smart idea from a smart guy who followed through on his idea. If someone had the idea before him they would have the burden to prove that they did invent it before he did in order to invalidate the patent. Just saying you came up with it first really does not hold up in court.

i hear what your saying but isnt it the same as . lets say i want to invent a hoster that you wear around your waist to hold a spray bottle and a sqeeze wax bottle. sounds good right? but the problem is you can just wear an apron and that will do the same thing .

lol, you guys are unreal, why is everyone trying to get into the legalities and stuff and give him all this crap for following thorugh with a good idea. so maybe he's not the only person to think of this but he's the only one who thought to get it patented and professionally manufactured instead of making messed up cuts all the time. i say good job. its a good idea and i think it will make things easier for the people who use this bucket, it seems like it just eliminates one more hassle and makes the job that much easier

Nope the Apron would be a different idea then a holster. Like I said, you can get a patent on almost anything if you get specific enought and as long as there is no prior art such as a patent, or a publication showing the idea. During the time a patent is pending you cannot stop others, only once you are granted a patent can you enforce it and stop others from making, buying, using, or selling it.
