I bought a flex 3401 and I was wondering if it needs a backing plate because it looks like it has one? I did buy on back it does not fit.

There are in total 4 backing plates available for the flex:

5.5" Flex BP
4 3/8 Flex BP

The LC interchangeable system which includes
6" BP
4" BP

Which pads are you trying to use?

Brian,

When bought new, the Flex 3401 come with a backing plate.

Flex 3401 backing plates are different than the normal backing plates used on the Porter Cable 7424 style dual action polisher and neither are compatible with one another. Click on the link below and choose your polisher for available options....

If purchased from Auto Geek (that's why I asked) then you'll definitely be taken care of. (From my past experiences)
