| | | Recieved another HOT CHECK. Advice on this one. Alright, I'm no stranger to getting hot checks lately.
I sold my Generator to an individual, from my business. He made the check to my business. Well, I got the check back. I charge a $35 returned check fee for these, and I make sure I let them know. I'm not the type of person to call and call, etc. Or turn it in as soon as I get it, to the hot check dept.
I like to be fair and give them the chance to correct the debt before taking further actions.
So anyways, I tried going to the address on the check, empty house, so I tried calling. Disconnected line. Crap. Well, I heard it through the grapevine that they moved to another place down the road and that he was in the Military, an MP at that.
So, since I had his First and Last name, as well as middle initial, I started calling the Military Base here trying to find out what Unit he belonged to. Well I found it, called, and made contact with him. This was maybe 2 weeks ago at the longest. Said he would make payment on the 12th of $200, plus the $35 fee. I said fine, since I let them try to make good.
Well, I get a message saying he cannot pay it right now. I tried calling back, no answer, so I leave a nice message.
I get another call from him today, again, I missed the call, but the other party left a message, stating he could only pay me half.
Now my question before I call him. Should I take half and wait? My gut is telling me NO. Or do I give him till tomorrow by Noon to make good before I contact his 1st SGT. and then turn the check over to start prosecuting? I was told I would get payment on the 12th and never did. I'm just wondering, if he makes half, and then never follows through, can I still turn the check over?
I've never had a problem collecting except this time.
And no, I will not ask him for the generator back. Who knows what it went through in the time it was out of my hands.

| | | i would honestly, not accept half...i would tell him what the deal is, tell him what you are going to do if he doesnt pay the full amount...if he didnt have the funds to get the gen. he shouldnt have got it...i would give him the date that he needs to pay the full amount...and if he doesnt...i would take the next step..just my 2 cents |

| | | You've worked with him enough. At some point excuses are no longer acceptable. Go to his commanding officer. Ask when you can expect it to be resolved. If you don't have money in hand by that date pursue it through the military legal system. |

If nothing else they will deduct the money from his paycheck and pay you directly, not to mention the additional punishment he will be getting. He's already proved to not be trustworthy, so teach him a lesson.

I had a 6'6" Army man in my face...yelling, towering over me on day.. I very calm told him to sit his a ss down, before I make a phone call to his commanding officer to report is behavior. The man quickly sat down and treated me with respect.. Trust me they fear getting into trouble. Your guy must not believe you will do it. Like Pauly said they will take it right out of his pay, or at least they use too.

I grew up in the Military life style...he must be a pansy ...prolly one of those guys that cry when training sessions happen...
u dont do that kinda sh*t to people...hes the kinda guy that probably would get caught for freindly fire

I tried calling, his Wife answered, said I have to take it up with him, and he will be home after 7:30 PM. Called @ 7:50, no answer. One more call this evening to leave a message telling him if payment is not made in full BEFORE noon tomorrow, I will have no other option but to take this to his commanding officer and go from there.
Will let you know how the other call goes this evening....

Let's just say, he tried to give her the run around. First he said he'll pay on the 12th, then he couldn't pay. Then he could only pay half this morning. Now when he talked to my Wife, said he could only pay $50, then the rest when he gets his check around the 1st of the month.
I received the check a month and a half ago. Ad now wants me to wait another half month.
Nah.... I'll be contacting his 1st SGT in the morning. Sorry, but if you cannot afford something, you shouldn't write a hot check, then try to put it off for 2 months..... I try to be fair and give them time to pay, but that is as far as I go.
I'll update the thread when I get some info.
